This website and online store (the “Services”) are operated by Tinkerstoneshop LLC d/b/a Tinkers (“Tinkers”, “we”, “us”, “our”). By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service (the “Terms”), including additional terms and policies referenced here or available by hyperlink.
Our store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services to you.
If you do not agree to these Terms, do not access or use the Services.
1. Online Store Terms & Eligibility
You represent that you are at least the age of majority in your state or province of residence. The Services are not directed to children under 13. If you are under 18 (or the age of majority where you live), you may use the Services only with consent of a parent or legal guardian. You may not use the Services for any illegal or unauthorized purpose or to violate any laws in your jurisdiction. Transmitting malware, viruses, worms, or destructive code is prohibited. A breach may result in immediate termination of your access.
2. General Conditions
We may refuse service to anyone for any reason at any time. Content you submit (excluding payment card data) may be transferred unencrypted over networks and adapted to technical requirements. Payment card data is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our prior written consent. Headings are for convenience only and do not limit the Terms.
3. Accuracy, Completeness & Timeliness of Information
Information on the Services is provided for general purposes only and may not be accurate, complete, or current. Your reliance is at your own risk. We may modify content at any time with no obligation to update any information.
4. Modifications to Services & Prices
Prices are subject to change without notice. We may modify or discontinue the Services (or any part) at any time without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance.
5. Products & Services
Certain products or services may be available exclusively online and may have limited quantities. Returns/exchanges are governed by our Return & Refund Policy (see link below). We attempt to display colors and images accurately, but your device settings may cause variations. We may limit sales to any person, region, or jurisdiction, limit quantities, change descriptions or pricing, and discontinue products at any time. We do not warrant that products/services will meet your expectations or that service errors will be corrected.
6. Orders, Billing & Account Information
We reserve the right to refuse any order. We may limit or cancel quantities per person, household, account, credit card, or billing/shipping address. If we change or cancel an order, we may attempt to notify you using the email and/or billing address/phone provided.
You agree to provide current, complete, and accurate purchase and account information and to promptly update details (email, card numbers, expiration dates) so we can complete transactions and contact you as needed.

7. Shipping & Delivery; Risk of Loss
Delivery times are estimates only and not guarantees. We are not responsible for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you upon our delivery of the products to the carrier, except where prohibited by applicable law. We are not responsible for delivery failures due to incorrect or incomplete addresses you provide. Some carriers may not deliver to P.O. Boxes. International orders may be subject to import duties/taxes levied by the destination country; these are your responsibility.
8. Optional Tools & New Features
You may be provided access to third-party tools over which we have no control or input (e.g., payment processors, fraud-prevention services). Such tools are provided “as is” and “as available” without any warranty or endorsement; your use is at your own risk and subject to the third party’s terms. Any new features or services introduced in the future will also be subject to these Terms.
9. Third-Party Links
The Services may include materials from third parties and links to third-party websites. We are not responsible for examining or evaluating third-party content and will have no liability for any third-party materials, websites, products, or services. Review third-party policies carefully before engaging in any transaction. Complaints or questions regarding third-party products should be directed to the third party.
10. User Comments, Reviews & Feedback
If you submit ideas, suggestions, proposals, plans, reviews, or other materials (“Feedback”), you grant Tinkers a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, translate, distribute, and display the Feedback in any medium for any purpose. You confirm you own or have rights to the Feedback and agree to clearly disclose any incentive received in connection with a review (as required by law). We may monitor, edit, or remove content that we determine unlawful, offensive, or otherwise objectionable. Do not submit content that infringes any third-party rights, includes malware, or misleads as to origin. You are solely responsible for your Feedback and its accuracy.
11. Personal Information & Privacy
Your submission of personal information through the store is governed by our Privacy Policy (see link in Footer). Because the Services are hosted by Shopify, certain personal information may also be processed by Shopify to operate and improve the Services as described in Shopify’s policies.
12. Errors, Inaccuracies & Omissions
Information on the Services may contain typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct, change, or update information, or cancel orders if any information is inaccurate, at any time without prior notice (including after you submit an order), except as limited by applicable law.
13. Prohibited Uses
In addition to other prohibitions stated herein, you are prohibited from using the Services or content: (a) for unlawful purposes; (b) to solicit unlawful acts; (c) to violate international, federal, state, provincial, or local laws; (d) to infringe our or others’ IP rights; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit malware or destructive code; (h) to collect or track personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent security features. We may terminate your use for violations.
14. Intellectual Property
All content and materials on the Services (including trademarks, text, images, graphics, video, audio, and their selection/arrangement) are owned by Tinkers and/or its licensors and are protected by applicable IP laws. You may use the Services for personal, non-commercial use only. No rights are granted by implication or otherwise except as expressly provided.
15. DMCA / IP Complaints
If you believe materials on the Services infringe your copyright, please send a detailed notice to contact@tinkers.store with information required by 17 U.S.C. §512(c)(3). We respond to valid notices in accordance with applicable law.
16. Disclaimer of Warranties
Except as expressly stated by Tinkers, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that use of the Services will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable. Some jurisdictions do not allow certain disclaimers; those disclaimers apply to the maximum extent permitted by law.
17. Limitation of Liability
To the fullest extent permitted by law, in no event shall Tinkers, our directors, officers, employees, affiliates, agents, contractors, suppliers, or licensors be liable for any indirect, incidental, punitive, special, or consequential damages (including lost profits, revenue, savings, data, or replacement costs) arising from or related to your use of the Services or any products. In no event will our aggregate liability to you exceed the amount you paid to us for the product(s) giving rise to the claim during the twelve (12) months preceding the event.
18. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Tinkers and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any third-party claim, demand, or liability (including reasonable attorneys’ fees) arising out of your breach of these Terms or violation of law or third-party rights. This does not require you to indemnify Tinkers for Tinkers’ own negligence or willful misconduct.
19. Severability
If any provision of these Terms is unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the unenforceable portion will be deemed severed without affecting the validity of remaining provisions.
20. Termination
We may terminate or suspend your access to the Services at any time without notice if we believe you have violated these Terms. You remain liable for amounts due up to and including the date of termination. Provisions that by their nature should survive termination shall survive (including IP, Feedback, Disclaimers, Limitations of Liability, Indemnification, Governing Law).
21. Force Majeure
Neither party is liable for delays or failure to perform due to causes beyond its reasonable control, including acts of God, natural disasters, acts of government, labor disputes, embargoes, carrier or telecommunications disruptions, or shortages of materials.
22. Governing Law & Venue
These Terms and any disputes arising out of or related hereto are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. You and Tinkerstoneshop LLC (d/b/a Tinkers) consent to the exclusive jurisdiction and venue of the state and federal courts located in Bernalillo County, New Mexico. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

You can review the most current version of these Terms on this page. We may update these Terms from time to time. Material changes will be notified as required by law and will be effective on the date specified in the notice. Your continued use of the Services constitutes acceptance of the changes.
